Day three of Officer Lindsey murder trial

UTICA, N.Y. -- Witness Alfonso Jefferson told the jury about what he saw the night Utica Police Officer Thomas Lindsey was killed.


"He was a tall person with a white hoodie and dark jeans," said Jefferson.


"Tall person, white hoodie, dark jeans," the prosecutor repeated, then asked, "Was the person walking, jogging, or running fast?"


Jefferson said, "Running fast."


Two witnesses took the stand Wednesday, testifying they saw someone leaving the scene of the shooting death of Utica Police officer Thomas Lindsey.


Day three of Officer Lindsey murder trial
The murder trial for the man accused of killing Utica Police Officer Thomas Lindsey continued Wednesday. Two witnesses claimed they saw a person running from the scene the night of the shooting. Our Jim McCann has more from Oneida County court.
Prosecutors said Wesley Molina-Cirino shot Officer Lindsey last April in the back of the head during a traffic stop on Nielson Street. The defense said Cirino didn't do it and questioned why one of the witnesses changed their testimony on Wednesday from their past recollection.


The jury also heard from Sammy Rivera's girlfriend, Neomi Diaz. Rivera is the man Officer Lindsey pulled over right before he was shot.


Diaz spoke about how she used to date Cirino and told the jury Rivera and Cirino were friends and that they all lived together, but that changed when Cirino lied about dating Diaz.


Diaz said Rivera came to get her at church the night Officer Lindsey was shot. She said he was crying and shaking saying that he'd been pulled over and a cop was shot in front of him.


Rivera is expected to take the stand Thursday.
